These terms govern your use of the ArtDaddy website, desktop application and hosted services. By using them, you agree to these terms.

Using ArtDaddy

You may use ArtDaddy only in compliance with applicable law and these terms. You are responsible for your account, your projects, the instructions you submit and the results you create. You must provide accurate account information and protect your sign-in credentials.

Open-source software

The ArtDaddy desktop application's source code is available under the GNU General Public License version 3. That license governs your rights to copy, modify and distribute the open-source code. These terms separately govern the website and any hosted services.

Your content

You retain your rights in content you provide and projects you create. You grant ArtDaddy and its service providers only the limited rights needed to process content when you deliberately use a hosted feature. You represent that you have the rights needed to use the content and to give those instructions.

Acceptable use

You must not use ArtDaddy to:

• break the law or violate another person's rights;
• create, upload or distribute malicious software or unlawful content;
• probe, disrupt or bypass security, rate limits or access controls;
• misrepresent generated or edited media in a deceptive or harmful way; or
• resell or overload a hosted service except under a written agreement with us.

Third-party services

Optional features may connect to third-party models, websites or services. Their terms, availability and output are outside our control. You are responsible for reviewing any third-party terms that apply to your use.

Changes, suspension and termination

We may change or discontinue hosted features, and we may limit or suspend access when reasonably necessary to protect users, comply with law or address misuse. You may stop using ArtDaddy at any time. Provisions that by their nature should survive termination, including ownership, disclaimers and limitations of liability, will survive.

Disclaimers

To the fullest extent permitted by law, ArtDaddy and its hosted services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation. AI and media-processing outputs may be incomplete, inaccurate or unsuitable; review them before relying on or publishing them.

Limitation of liability

To the fullest extent permitted by law, ArtDaddy and its contributors will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or business opportunities arising from your use of the services. Nothing in these terms limits liability that cannot legally be limited.

Changes to these terms

We may update these terms. We will publish revised terms here and change the effective date above. Your continued use after an update means you accept the revised terms.
