Terms of Service
The ArtDaddy editor is free and open source under the GPL-3.0 licence, and works without an account. These terms cover ArtDaddy's hosted AI service and its credit plans.
1. Who we are and what these terms cover
ArtDaddy is made and published by AUTOSHOT PRIVATE LIMITED, a company incorporated in India (“ArtDaddy”, “we”, “us”). Company details are on the About page.
These terms are the agreement between you and us for the ArtDaddy hosted service: the AI features that run on our servers (such as generation of video, images, music and voice-overs), your account, credits and paid plans. Together we call these the “Service”.
The desktop application is open source and licensed to you under the GPL-3.0 licence, which these terms do not change. The Service is separate: it runs on our servers, holds our provider keys and billing, and is not open source.
By creating an account, buying a plan or using the Service you agree to these terms and to our Privacy policy. If you do not agree, do not use the Service. The editor works without it.
2. Your account
- Sign in with a valid email address through our sign-in provider, Clerk. Keep your sign-in secure. You are responsible for what happens under your account.
- An account is for one person. Do not share it, sell it or let others use your credits.
- Each person may claim the free credits once. Creating extra accounts to get more free credits is not allowed, and we may remove those credits and close those accounts.
- You must be old enough to enter a binding contract where you live (usually 18). If you are younger, a parent or guardian must agree to these terms for you.
3. Plans, credits and payment
- The editor is free. Paid plans and top-ups are credits for generating video, images, music and voice-overs, and they are launching soon. Until they launch, the Service runs on the free credits every new account gets, and the rest of this section applies from the day they launch.
- The Pricing page lists the plans, prices and credits. Prices are in US dollars and do not include tax.
- Payments will be processed by Dodo Payments, the Merchant of Record for your purchase. Dodo will sell the plan or credits to you, collect any VAT, GST or sales tax, and issue your receipt. Dodo's terms will apply to the checkout.
- Subscriptions renew automatically each billing period until you cancel. Cancelling takes effect at the end of the period you have paid for. See the Refund and cancellation policy.
- Credits pay for AI requests. Plan credits renew with each billing period and do not roll over. Top-up credits last 12 months from your most recent top-up. Free credits are a one-time grant. When you spend credits, plan credits go first, then top-up credits, then free credits.
- Credits are added only after a payment is confirmed.
- Credits have no cash value, cannot be transferred or exchanged for money, and are not a currency or a stored-value product. Except as set out in the refund policy or required by law, credits are not refundable.
- The number of credits a request costs depends on the model and on the size or length of the request, and can change as our costs change. A change never reduces the credits already in your balance.
- We will tell you before a price change applies to your next renewal, and you can cancel before it does.
4. Acceptable use
You may use the Service only for lawful purposes. You must not use it to create, request, upload or share:
- sexually explicit or pornographic content, or sexualised content of a real person;
- any sexual content involving minors, or any content that sexualises or endangers children. We will report it to the relevant authorities where the law requires or allows;
- intimate images of a real person without their consent, including “undressing” or nudifying a photo;
- content that impersonates a real person, or shows a real person doing or saying something they did not, without their clear consent or in order to mislead (deepfakes), including imitating a real person's voice;
- content that harasses or threatens people, incites violence or hatred against a person or group, or promotes terrorism or self-harm;
- content that is illegal, or that is used for fraud, scams, phishing, malware or spam;
- content that infringes someone else's copyright, trademark, privacy or publicity rights. You must have the right to use any media, text or other material you import, download or provide to the Service, including as a reference for generation;
- content meant to deceive people about real events, such as fabricated news footage or fake evidence.
You also must not:
- try to get around, disable or test the limits of our safety measures or of our AI providers' safety systems, including by writing prompts meant to trick a model into producing prohibited content;
- harm, overload or probe our systems, or access the Service by any means other than the ArtDaddy app and its MCP server;
- resell, sublicense or share access to the Service or your credits.
Our AI providers' usage policies also apply to what you create, for example Google's Generative AI Prohibited Use Policy and Microsoft's Code of Conduct for Azure OpenAI.
Safety filters may block a request, and they are not perfect. We and our providers may refuse any request. If you see content that breaks these rules, email support@artdaddy.app.
If you break these rules we may refuse requests, limit features, suspend or close your account and remove unspent credits without a refund, and we may report unlawful content to the authorities.
5. AI output and your content
- AI output can be wrong, unexpected, offensive or similar to other people's output. You are responsible for checking it and for how you use it.
- Where the law, or a platform you publish on, requires you to say that content is AI-generated, you are responsible for saying so.
- We do not claim ownership of your media, prompts or output. As between you and us, you own what you import and the output you create, to the extent the law allows, subject to the rights of third parties and your duties under these terms.
- You give us a limited licence to process your prompts, media and output only to run the Service, including sending them to the AI providers that process your requests. We do not grant those providers permission to train on your content, and we do not sell your data. The Privacy policy has the detail.
6. Availability and changes
We work to keep the Service running, but we do not promise it will be uninterrupted or free of errors. AI providers change and retire models, so we may change, replace or remove models and features. Where we can, we will tell you in advance of a change that materially reduces what a paid plan offers.
7. Our rights
The ArtDaddy name and logo are ours. The source code of the desktop application is available under the GPL-3.0 licence. The Service itself, meaning our servers and the software that runs them, is proprietary.
8. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we give no warranty that the Service will meet your needs or that output will be accurate, lawful or non-infringing. Nothing in these terms excludes a warranty or right that cannot be excluded by law.
9. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost data or projects, and our total liability to you for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.
10. Ending these terms
You can stop using the Service and cancel your plan at any time. To delete your account, email us. We may suspend or end your access if you break these terms, if the law requires it, or if a payment is reversed or disputed. When your access ends, unspent credits are lost, unless a refund applies under the refund policy or the law.
11. Governing law
These terms are governed by the laws of India, and the courts at New Delhi have exclusive jurisdiction. This does not take away any right you have under the mandatory consumer law of the place where you live.
12. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is material, we will tell you by email or in the app before it applies. If you keep using the Service after a change you accept it; if you do not accept it, stop using the Service and cancel your plan.
